General Purpose and Responsibilities of the Position:

The Regulatory Attorney will actively support Switch’s current and future energy, water, and sustainability initiatives in compliance and accordance with federal and state law, orders, and regulations while supporting this rapidly growing organization. The Regulatory Attorney’s responsibilities will include reviewing, analyzing, and applying federal and state energy laws and regulations to Switch energy and utility contracts; strategically considering and intervening in public utility commission cases and other dockets in several jurisdictions; analyzing water rights and ancillary agreements; and reviewing environmental permits and permitting obligations to ensure compliance with federal and local agency regulations in accordance with Switch’s business initiatives. This position will be required to travel to our different Prime locations and assist with project managing any current or futuristic plans around development, power, generators and other related organizational initiatives as needed.

Essential Duties and Responsibilities:

• Ensure overall compliance of the terms and conditions of contracts, permits and other applicable documents with established policies, procedures and regulations
• Draft, review, and manage power and water contracts, power studies, and related documents and provide detailed summaries of the same to the executive management team
• Research and analyze contractual terms and industry laws, regulations, rules, and practices pertaining to utility and environmental related agreements
• Appear, monitor, and participate in PUC, FERC, legislative, and other regulatory hearings
• Monitor and track PUC dockets, and prepare pleadings for all Switch-interested PUC dockets
• Work with consultants and other third-parties to ensure Switch regulatory strategies are met and meet EPA and state agency compliance requirements
• Draft and support the creation of environmental, power, and sustainability policies
• Oversee the submittal of all utility contracts and environmental applications to obtain applicable permits
• Monitor and have a comprehensive understanding of all new utility requests and contracts, permit applications, permits, amendments, renewals, and planning forecasts relating to the same
• Work closely and collaboratively with Switch Energy, Sustainability, Construction, and Development teams on environmental requirements and strategic development initiatives

Education and Experience:

Certification:

• Active Bar License in Georgia, Michigan, Nevada, and/or Texas

Education:                   

• Juris Doctorate from an accredited law school
• Bachelor’s degree from an accredited university (preferred degree or focus in energy, environmental or related field)

Experience:                 

• Minimum 5 years’ experience in the energy, development, energy generation, water, and/or permitting and contracting sector
• In-depth knowledge of EPA air permitting statutes, regulations, and guidelines
• Commencing and litigating cases with a public utilities commission

Preferred Experience:  

• Development of strategies and implementing energy generation projects
• Development of rates and rate-setting processes and programs for energy and water
• Litigating other regulatory matters
• Prior work experience with a utility in energy generation, transmission, distribution, and/or import/capacity rights

Travel:

Must be able to travel at least 25% of the time across the United States
